The amount of wear and maintenance that can be considered appropriate depends on how long you lived in the rental unit and the condition of the unit when you moved in. The law does not allow an owner to use a security deposit to upgrade or update the unit. If the carpet was worn during the move, the owner cannot keep your deposit to replace the worn carpet when you remove. The law also does not allow the owner to use your deposit to repair the damage that was already there when you moved in. Within 14 days of informing the owner that you have left the device, the owner must return your deposit and/or inform you in writing of the reasons why they are not returned in whole or in part. 9 V.S.A.
